Law my a$$ Sony owns VISUAL CREATION STUDIO MS does not hold the RIGHT to Visual RPG Studio. And no I dont respect Things like apple is doing with the word POD. Lawsuits are not LAW. About one step away from getting sick of this topic for wasting my time.
 
Funny because it seems you are. Other Example http://vstorytellersstudio.blogspot.com ... chive.html . They hold no right to the word visual or studio. They only have the right to how its displayed in the trademark 'Visual Studio'.

Not sure what law books you are reading but last time I check lawsuits never make laws. Are you studying law in England. Or maybe Ohio forgot to update its books. So show me the law i'm breaking and i'll be more than willing to change it again.

I now have the IO for the particle emitter system working. This dones not mean I'm done with particles.

TODO in PARTICLES
1. Spell propertie to link the emitter to player and npc spells
2. Particle Emitter Templates
3. Non-tile based emitter attribute for use of emitter in UI, and or non-tiled based games.
4. Update the Particle Features page on the website.

Ever heard of laws being updated and changed based on court rulings? Yeah, it happens. You probably won't get sued because your program isn't a real threat to any major company. Do I think you could get a C and D? It's possible. I think if you keep the words Visual and Studio apart you will be okay for the most part. The part Microsoft would be touchy about, in my mind, is that if someone searches for 'Visual Studio' your product will come up, which uses their brand recognition. I'm not a lawyer, so I don't know EXACTLY how that would work, but using brand recognition, intentional or not, doesn't go over well.

If you require 'proof' that the lawsuits Glitch refers mostly to are true and currently happening, look up the whole David Ortiz VS. Jay-Z. Ortiz opened a night club called 'Forty/Forty' and Jay Z owns a club called '40/40' and he's suing Ortiz for it.
And his clubs not even in the same country. It's not exactly the same, but the stuff does happen.

I also agree with your last post. I am in no way trying to pass VRS off as VS. ONly thing that is the same is the propertiesGrid control witch is open to the public in the .net framework. I also agree like any company I could be sued. The Apple 'POD' Example by Glitchfinder is a great demonstration of this. The name LRM would of been branding because I am looking to take EB RM users. They hold major IP rights to the name 'RPG Maker' (VX or not).

I say lose all ties to RPG Maker and Visual Studios. It's best if you truly come up with a unique name that defines YOUR product and not SOMEONE ELSE'S, in whole or part. Also keep in mind that it's not just large corporations you have to watch for, but small well known business as well. When choosing a name you need to do more then just the basic search.

1) GOOGLE it or use any search engine. The quickest way to see if it is possibly available.

*Okay so it did not show up in Google to anything relevant...

2) TRADEMARK search. The internet is pron to many paid and free trademark search sites. Some can also do international trademark searches. Doesn't matter if you live in the US or not brand an item using a name to a major foreign company (which probably has a branch or division in the US or other country) and well they may come knocking.

*Okay so trademark is good right? Wrong...

3) DOMAIN SEARCH is also good as well as most people do not know that a domain name can be trademarked. If the domain name is not in use it's more likely not in use as a product or business name. If you are told it is taken visit the site. If a place holder page is there you might be able to buy it; of course keep in mind some people buy domain names to resell them for outrageous prices.

Research is the key here as people think that, "they won't bother me I'm just some dude in my bedroom," and then they get a wake up call. Reason being if they see a way to make more money (and in some cases a lawsuit can do this) they will do it.
 
The fact that apple is raising hell over POD is stupid. It stands for portable on demand. That's all. But its a brand recognition thing and it's just damn silly.

Beta is now live. I am allowing anyone to download it and test it for free. All I ask in return is you give any feedback you may have using the LastEnd Forums.

1. Maze Template got down sized to 3 levels.
2. Tool bar now shows when user is adding objects.

Bugs Fixed version 0.6.9 Beta

1. Base Particle file was added to the template to allow for particles to be added.
2. You can now see Collision painting
3. (Spelling error) 'Pallet' [Wood object for stacking boxes on] change to be 'Palette'.
4. Application, about dialog, and welcome screen now pull the right name from the Assembly information.
5. Gameboard Grid no longer crashes.

Visual RPG Studio now has a new Box design. We created this new design for VRS because of the name change from LastEnd RPG Maker to LastEnd Visual RPG Studio. Bellow is the new box designs that can be view in a larger format. Let me know what you think.

Question, with so many features missing, why is this beta and not pre-alpha? Have you constructed a complete feature set, started unit testing, and all that other nonsense?
