RMXP - Silence spell not working correctly

Anyone know much about the State scripts that would deal with the character having Silence cast on them? Example:
In battle, the party member ques up an attack spell, but the enemy casts Silence on him first and succeeds, but the next action the party member still casts his spell even though he's been affected with the State of Silence (which prevents spells from being cast). I can't find where the checks and balance in the scripting would be located that handles this. I still need to check if the very next action by the party member allows a spell to be perfomed once he cast the queued spell after being Silenced.
 
weird... after a couple tests, the Silence spell did work properly. I queue a spell and Silence is cast by the enemy before i can cast it and the turn ends without the hero casting the queued spell. the next action the hero cant cast spells... rather odd. It only happened once when the hero still cast the queued spell after Silence was put on them. i get you little bug!
