Nintendo Sued!?

If they do, it's evidence of a broken patent system. The idiots suing Sony had a case. They didn't patent rumbling itself; they patented a very specific way of doing so. What Ninty's doing here is fairly different.

Fans of Nintendo need to remember you can't just scoff at a case and dismiss it out of hand because Nintendo is big and you like them. In this instance it looks to me like the resemblance is more of a superficial matter, i.e. how the 3d mouse in question looks is the plaintiff's grounds for infringement. That seems pretty trivial to me and I doubt he will get his massive request, but there is a distinct possibility he will get some returns, as the patent does put a lot of weight on the control shape of the mouse, which is very much like the wii main controller. If they give him even close to his full request I will be very surprised, but they might ask Nintendo to give him a minor royalty if he is lucky.

Don't diss the guy though. If you had a chance at millions of dollars because you had lucked onto a patent that wound up being very similar to something as major as the Wii, would you pass up the chance? I doubt even the biggest Nintendo fanboy would pass up a chance like that, especially since he has a good chance of netting at least enough to cover his lawyer fees and turn a profit. That profit could be spent buying Wii games, dude.

It does boggle my mind that he is asking for the Wii to be taken off the market, but perhaps he intends to start high and have them settle out of court to avoid trouble.
 
Suits like this aren't always the money grab they look like, they're required because of the stupid way patents work.

Honestly the Wii-mote feels much more like a remote control with a Z-trigger, which exists in several products I own, including a presentation mouse/pointer device that's a bit more sleek.

The resemblance may seem uncanny, but then again, there are a ton of TV/VCR/DVD/Everything remotes out there that also look very alike.

This case has the potential to do some damage to Nintendo, but it should not by any rights. Any market share this stole was from fanboys and tech-junkies who insist on engineering any gadget out there to do something it wasn't intended to do.

Nintendo also had the whole Z-trigger thing with the N64, this really isn't anything more than a TV remote with an N64 Z-trigger on the bottom. I will admit not reading much into their remote, but does it also act using a positioning through Bluetooth to read movements?

Hell, I made devices that looked like that with legos when I was a kid as pretend toys, it's not some break-through design, and I'm surprised it hasn't already been patented elsewhere.
