General Motors is BS! over warranties...

GM, is declining more and more warranties. Even under EPA they try to place the blame on small technicalities caused by the owner even if not proven.

Personal Example:
06' Chevy Cobalt - 24,398 MI
Head Gasket Blown , Causing water to mix with the oil which caused grey sluge to build when my car overheated...
(Mechanic Diagnosed)

The dealership took 5 days to respond and informed me that they wont service my car! Even after GM guaranteed the service! I spoke with a GM rep. they stated provide "receipts" for oil changes to provide proof of maintenance to the vehicle and the vehicle will be serviced. Two days later, I gather the receipts from the businesses and called back they said they would service my car and escalate my case for money lost due to my vehicle not being serviced in a timely manner. When escalated the DM of GM stated "Due to lack of maintenance the vehicle will not be serviced, because of the sludge in the engine." I stated I had proof of the oil changes and that the diagnoses stated what caused the sludge and they kept repeating that to me. Final word says we stand by our reps...

EPA and I are in contact now over the matter, also the news, and my lawyer.

Just wanted some insight from the good people here and also to warn people of this matter!
 
2. Clean Air Act Warranty Provisions (42 U.S.C. S 7541 (C) (3) (B))
The federal Clean Air Act requires vehicle makers to provide two emissions-related warranties -- a production warranty and a performance warranty. The production warranty requires the vehicle maker to warrant that the vehicle is designed, built and equipped so that it conforms with emissions requirements at the time of sale. The performance warranty requires the vehicle maker to warrant that the vehicle will comply with applicable emissions requirements as tested under state vehicle emissions inspection programs for the warranty periods specified in the law (for model year 1995 and later vehicles, the warranty is 2 years / 24,000 miles for all emissions-related parts and 8 years / 80,000 miles for the catalytic converter, electronic emissions control unit and on-board diagnostic device). The performance warranty is conditioned on the vehicle being properly maintained and operated.

Like the Magnuson-Moss Act, vehicle manufacturers may not refuse warranty repairs under the Clean Air Acts performance and defect warranties merely because aftermarket parts have been installed on the vehicle. The only circumstance under which the vehicle manufacturer can void the emissions warranties is if an aftermarket part is responsible for (causes) the warranty claim.

@Mega Flare: nope... i actually did nothing lol but regular maintenance on my vehicle as stated above i am covered under warranty.

@Incognitus: your absolutely right.. something should be done! Obama made a government resource available to new car buyers but not ones that already own a GM vehicle...
 
that's total bullshit, dude. i'm sorry you're getting worked over like that by them. i'm just happy that ford hasn't gone belly-up yet or i'd be in the same boat as you.

you're smart getting the news involved. don't let them fuck with you.
they have a contractual obligation to uphold and it doesn't matter if they are going through tough times, it's their responsibility to uphold their side of the bargain.

if you were going bankrupt but owed them money, would they give a shit? no obv not!

all you can do unfortunately is just try to make them as uncomfortable as possible. at the dealership and in the media. a squeaky wheel gets the grease.
 
Your head gasket has nothing to do with emissions related repair. That's exhaust stuff. Head Gaskets blow because of engine sludge built by bad oil. You either, didn't get timely oil changes (once every five thousand miles) or your last oil change guy didn't do it and charged you anyway. The latter you will have to seek remediation from the maintenance shop that botched your oil change.

If there is an alternative reason for the sludge in your engine it would be helpful to determine whether the fault is gm's or the shop you used for maintenance.
