Teen Murderer Says Jail Is Too Hard, Appeals Sentence

DAYTONA BEACH, Fla. -- One of the teenagers responsible for beating a Holly Hill homeless man to death asked a judge to reduce his 22-year prison sentence Monday. Warren Messner and three other teens pled guilty to killing the man because they were bored, but Messner said prison is too hard.

Messner is a big boy. He was 15 at the time he was brought into the woods to see the homeless man his friends had been beating. Even at that young age, he outweighed the victim, Michael Roberts, by 200 pounds when he jumped on his chest, crushing his ribcage. Roberts died.

"Did you feel bad when you are doing it?" Messner was asked during questioning.

"Not really, no," he replied.

He didn't feel bad then, but he does now. He has been in juvenile detention for eight months, locked in a small cell and occasionally allowed to go to class.

Messner and his attorney said he has already learned his lesson and is ready to go home to help others.

"I want to be an inspirational speaker for troubled teens," he said Monday.

Messner got the lightest sentence of the four boys. Teens Jeffrey Spurgeon, Justin Stearns and Christopher Scamahorn got 27 to 35 years. They all cut plea deals to avoid life in prison.

The state attorney said that's as much leniency as they should get and the judge agreed.

"I can't think of some reason to change the sentence. I'm going to deny the motion," said the Hon. Joseph Will.

Messner's parents broke down at the denial. His mother said it's unfair, that her son fell in with a bad crowd and prison is killing him.

"He's not getting the mental health, the schooling. He's not getting anything, anything but locked in a cell all day long," Lori Messner said.

The judge and the state both argued that being deprived services and being locked away is precisely the point of prison. Warren Messner will spend the next 22 years in prison without the chance for parole.

Seriously, TOO HARD? Just because of that you should be allowed to walk away, despite having brutally killed a man?

Wow, that kid must have been really stupid. Not only did he kill a man with no provocation without thinking of the consequences, he couldn't even lie about remorse. Yikes.

I somehow doubt he's learned his lesson, and I'm glad the people in charge saw through this.

Seriously, though, they should put some thought into letting him be a motivational speaker while in prison. Seeing some fat tough kid cry about how rough prison is might give it at least a little more weight.

That cruel boy, he deserves more than what the others got, he killed him, and, AND, he didn't care.

No, the boy's psychopathic. And no, he should not be kept in jail like that. He should definitely be talking to people about the shit he's landed himself in, and then he should be educated in a useful trade so that when he gets out of prison he can do something more than snatch purses from old women. Otherwise you're simply taking damaged and dangerous elements of society, taking away any chance they have of rejoining that society, and putting them in a room with hundreds of other criminals, so they can learn lead a proper criminal life. Forgive me if that doesn't seem clever.

PS I really don't trust this article to have given a good account of the scenario. And why is it so badly written?

I agree with you to an extent, but I also think he should be punished for what he did. Letting him out so he can become a fucntionable member of society/motivational speaker will do little to suppress his mental disorder (if any). You'll just have a guiltless, free murder who can repair air conditioners.

Somehow, I doubt that if he does rejoin society at age 37, that anyone will hire a man that brutally murdered a homeless man for no reason-I know I wouldn't. I think he's ruined his life already.

it's much better to hope that he has a chance outside of prison, and attempt to teach him a useful trade while he is there, than to assume he is unhireable and let his mind and body rot away. Then he may as well just be killed, or his organs harvested for donation banks or something. Since this topic is not a death penalty debate, and should not turn into one, going with the status quo it seems a logical argument that he should be trained while in prison. Likewise he should be allowed to use his prison sentence to educate other kids about how much prison sucks... but he should not be allowed to get out of prison to do so.
