MP3 Licensing... legal?

It would seem that each game title utilizing MP3 technology needs to pay a $2500 licensing fee. Does RM have an enterprise license, or something of the like? Or are our games not "titles" persay, but more "plugins" for Rpg Maker?
I'd like to get some thoughts on this.

commercially, yeah, but most commercial games dont use mp3's, they use ogg's or wav files.

But still - would have been cool if they gave a warning snippet somewhere in RM. Unless the patent isn't valid/registered in Japan...

RM isnt at its base a commercially used engine. Most professionals code games or create their own engines, so those using RM for commercial projects (Aveyond, etc) know the risks before hand; it isnt Enterbrain's fault for not putting a disclaimer.

Just ogg files to be at the safe side. Ogg is pretty awesome anyway (except the name, which reminds me of a sound i'd make while vomiting).
