... could I get sued for this?

Okay...  I was working on my game Moon Rising, when suddenly I thought;  This is well, boring.  I started listening to my Chrono Cross Sound Track, and really started thinking about making a Chrono Cross remake, using  custom sprites, and faces from the game.  I was excited about it, until I got to the music;  I want to use Chrono Cross's soundtrack, but I don't want to get sued >. >  If I just made the game and gave it away for free (encrypting the sound some how) then would it be legal?

I think that this is one of my best ideas ever, and I really want to do it...

If I make it and don't release it to the public (just release it to my friends who are fans of the Chrono series), then would it be any more legal?

Keep in mind that you'll usually get a cease and desist letter long before you are sued.

There was a 3d remake of Crono Trigger that was forced not to release to the public, but they did finish it apparently.
